We may receive information from HOA boards or property managers who arrange lighting on behalf of residents; from Facebook, Instagram, Nextdoor, and TikTok when you interact with our pages; from Google when you find us through search or reviews; and from advertising platforms that report on ad performance.
What we do not collect
We do not knowingly collect biometric identifiers, precise geolocation, government ID numbers, health information, or other categories of sensitive personal data as defined by the TDPSA. We do not sell sensitive personal data or biometric personal data.
03Why we collect it
We process personal data to:
- Prepare estimates and mock-up photos of your property with lighting designs
- Schedule and perform installation, maintenance, service calls, takedown, and off-season storage
- Communicate with you about your project by phone, text, or email
- Process payments and administer contracts, including multi-year agreements
- Provide warranty service and respond to issues during the season
- Send appointment reminders and, with your permission, seasonal promotions
- Display completed work in our online gallery and on social media — see Section 4
- Improve the Site, measure advertising, and understand which service areas to expand into
- Comply with law, resolve disputes, maintain insurance coverage, and enforce our agreements
04Photographs of your property
Photos are central to how we work. We take photos of your property before installation for design and mock-ups, during installation, and after completion.
- Design and service photos are used internally to plan your display, document condition, and reproduce your design in future seasons.
- Marketing photos may appear in our website gallery, catalog, social media accounts, and advertising.
We do not publish street addresses, house numbers, or customer names alongside marketing photos unless you specifically approve it. If you would prefer that photos of your property never be used in marketing, tell us in writing at hardwork@amchristmaslights.com and we will honor that request going forward and remove existing images from channels we control.
05Who we share personal data with
We do not sell your personal data for money.
We share personal data with the following categories of third parties, only as needed to run the business:

Under the TDPSA, sharing data with advertising platforms for targeted advertising may be treated as a sale of personal data in some circumstances, because it involves disclosure for valuable consideration. You may opt out of this at any time — see Section 7.
We do not sell or share your mobile phone number or text messaging consent with third parties or affiliates for their own marketing purposes.
06Text messages and calls
If you give us your mobile number, we may contact you by call or text about your estimate, appointment scheduling, crew arrival, service issues, and billing.

The Texas Data Privacy and Security Act gives Texas residents the following rights regarding personal data we hold about them:
- Confirm and access — Confirm whether we are processing your personal data and access that data.
- Correct — Correct inaccuracies, taking into account the nature of the data and our purpose for processing it.
- Delete — Delete personal data you provided or that we obtained about you.
- Portability — Obtain a copy of your personal data in a portable, readily usable format, where processing is carried out by automated means.

How to submit a request
Email hardwork@amchristmaslights.com with the subject line “Texas Privacy Request,” or call or text (817) 715-2816. Please describe which right you are exercising. We may ask for information to verify your identity and connection to the account, commonly the service address and the email or phone number on file. If we cannot authenticate a request by reasonable effort, we may decline it.
Our response
We will respond within 45 days. If we need more time, we may extend once by an additional 45 days and will tell you why within the original window. Requests are free up to twice in any 12-month period; we may charge a reasonable fee for excessive, repetitive, or manifestly unfounded requests, or decline them.
Appeals
If we decline your request, we will explain why and tell you how to appeal. To appeal, reply to our decision or email hardwork@amchristmaslights.com with the subject line “Privacy Appeal.” We will respond in writing within 60 days of receiving the appeal, with an explanation of our reasoning.
If your appeal is denied, you may submit a complaint to the Texas Attorney General at texasattorneygeneral.gov/consumer-protection/file-consumer-complaint.
Universal opt-out signals
We recognize universal opt-out mechanisms such as the Global Privacy Control (GPC). If your browser or extension sends a GPC signal, we treat it as a request to opt out of targeted advertising and any sale of personal data associated with that browser.
08Cookies and tracking
Our Site uses:
- Strictly necessary cookies — required for pages, forms, and the shopping cart to function.
- Analytics cookies — help us understand traffic and which pages lead to quote requests.
- Advertising cookies and pixels — used by platforms such as Google and Meta to measure and target our ads.
You can block or delete cookies in your browser settings, though the cart and some forms may not work correctly if strictly necessary cookies are blocked. You can also opt out of interest-based advertising through the Digital Advertising Alliance at optout.aboutads.info and the Network Advertising Initiative at optout.networkadvertising.org.
09Data retention
We keep personal data only as long as reasonably necessary:
- Active customer records — for the duration of your relationship with us, including multi-year lighting contracts and off-season storage arrangements.
- Design records and property photos — up to 5 years after your last service, so we can reproduce your display in future seasons.
- Financial and tax records — as required by law, typically at least 7 years.
- Marketing contacts — until you unsubscribe or ask us to delete them.
- Website analytics — per the retention settings of our analytics providers.
10Security and breach notification
We use reasonable administrative, technical, and physical safeguards appropriate to the volume and nature of the data we handle, including limiting crew access to only the customer details needed for a job, using reputable hosting and payment vendors, and not storing full payment card numbers ourselves. No method of transmission or storage is perfectly secure, and we cannot guarantee absolute security.
If a breach of system security involving sensitive personal information occurs, we will notify affected individuals as required by the Texas Identity Theft Enforcement and Protection Act, Texas Business & Commerce Code Chapter 521, without unreasonable delay and no later than 60 days after determining a breach occurred. If a breach affects 250 or more Texas residents, we will also notify the Texas Attorney General within the timeframe the statute requires.
11Children’s privacy
Our Site and services are directed to adults. We do not knowingly collect personal data from children under 13, and we do not knowingly process the personal data of a known minor under 18 for targeted advertising or sale. If you believe a child has provided us personal data, contact us and we will delete it.
12Out-of-state and international visitors
We serve customers in Texas. If you access the Site from outside Texas or outside the United States, your information will be processed in the United States, where privacy laws may differ from those in your location. If you are a resident of another U.S. state with a comprehensive privacy law, contact us and we will address your request under the applicable law.
13Third-party links
The Site links to Facebook, Instagram, Nextdoor, TikTok, and other outside sites. We are not responsible for their privacy practices. Review their policies before providing personal data to them.
14Changes to this policy
We may update this Privacy Policy. When we do, we will revise the “last updated” date above. If changes are material, we will provide additional notice, by email to customers on file or by a notice on the Site. Continued use of the Site or our services after an update means you accept the revised policy.
